LECTRA TERMS OF SERVICE

These Terms of Service ("Agreement") govern your use of Lectra Technologies, Inc.'s products and services. Please read them carefully before using our device, app, or related content.

Lectra is currently in pre-launch / waitlist mode. Our device is pending FDA 510(k) clearance and is not yet authorized for distribution or use. Reservations placed today will not ship until clearance is obtained. Information on this site is provided for informational and reservation purposes only and does not constitute medical advice, a clinical claim, or a representation of safety or efficacy.

  1. WHO WE ARE AND HOW THIS AGREEMENT APPLIES

Lectra Technologies, Inc. ("Lectra," "we," "us," or "our") is a U.S.-based company offering a wearable muscle stimulation system integrating a Bluetooth-enabled device, dry electrode kinesiology tape, and a companion mobile application (the "Services").

This Agreement applies to your use of:

The Lectra wearable muscle stimulation unit ("Lectra Device")
Lectra's specialized kinesiology tape and electrode components
The Lectra mobile app
Any other associated software, content, or services provided by Lectra

By using any part of the Lectra Services, you agree to be legally bound by this Agreement. If you do not agree, you may not use the Services.

  1. ELIGIBILITY AND REGISTRATION

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. If you are under the legal age to form a binding contract, your use must be supervised by a parent or legal guardian.

To access certain features, you may need to create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

  1. USE OF SERVICES

Lectra grants you a limited, non-transferable, non-exclusive license to use the Lectra Device and app for personal or approved professional use. You may not:

Reverse engineer, decompile, or disassemble the software
Reproduce or distribute any part of the Services without our written consent
Use the Services in any unlawful or harmful manner

  1. MEMBERSHIP & SUBSCRIPTIONS

Lectra may offer optional subscriptions in the future that include:

Replenishment of consumables (e.g., kinesiology tape)
Access to premium in-app content (e.g., guided recovery programs)

Details, pricing, and terms will be provided at the time of subscription offer. All subscriptions will auto-renew unless canceled.

  1. RETURNS & WARRANTY

Lectra offers a 30-day return policy from the date of delivery for eligible purchases. Products must be returned in their original condition. Customer is responsible for return shipping unless otherwise stated.

Lectra devices are covered by a limited one-year warranty against defects in materials and workmanship. This warranty does not cover damage due to misuse, normal wear, or unauthorized modifications.

  1. FDA REGULATORY STATUS

Lectra's device is currently pending FDA 510(k) clearance as a Class II medical device and is not yet authorized for sale, distribution, or use. The device is not cleared, approved, or indicated for any medical use at this time.

Once cleared, Lectra will be marketed in accordance with the labeling and indications authorized by FDA. Any descriptions of intended use elsewhere in our materials are conditional on clearance and are not a representation of safety, efficacy, or current availability.

Until clearance:

  • Lectra is not available for purchase or distribution.
  • Reservations placed through our website are subject to the Return and Refund Policy and are fully refundable at any time before shipment.
  • No medical advice or clinical claims are made by Lectra or through this website.

For any questions regarding your health, consult a licensed healthcare provider.

  1. PROFESSIONAL USE

Following clearance, Lectra may be used by licensed clinicians, physical therapists, and authorized professionals as part of a rehabilitation or performance program. It is the responsibility of such professionals to ensure that their use of Lectra complies with all applicable local, state, and federal laws, including requirements under HIPAA, licensing regulations, and professional standards of care.

  1. DATA AND PRIVACY

Lectra may collect certain biometric and usage data (e.g., session duration, muscle activation data) through its app and device once the device is cleared and made available. No voice or location data is collected.

  1. INTELLECTUAL PROPERTY

All content and technology used in the Services are owned by Lectra or its licensors. You may not copy, reproduce, or exploit any part of the Services without express permission.

  1. CHANGES TO SERVICES OR TERMS

We may modify these Terms or the Services at any time. Material changes will be notified in advance. Continued use after changes means you accept the updated Terms.

  1. LIMITATION OF LIABILITY

To the maximum extent allowed by law, Lectra is not liable for indirect, incidental, or consequential damages. In no event shall our liability exceed the amount you paid for the product or Services.

  1. PAYMENT DISPUTES AND CHARGEBACKS

Before initiating a chargeback, dispute, or reversal with your card issuer or payment provider, you agree to first contact Lectra Technologies, Inc. at support@lectra.tech and provide us a minimum of seven (7) days to attempt resolution. Initiating a chargeback without first contacting us is a material breach of this Agreement.

In the event of a chargeback that we determine in good faith to be improper or fraudulent (for example, where the product was confirmed delivered and not returned), we reserve the right to (a) submit evidence in our defense to the issuing bank, (b) report the dispute to consumer-protection databases, and (c) recover associated chargeback fees and the value of unreturned merchandise.

You waive any right to participate in a class action, consolidated action, or representative proceeding against Lectra Technologies, Inc. in connection with any payment dispute.

  1. GOVERNING LAW

This Agreement is governed by the laws of the United States and the State of Delaware. Disputes will be resolved through binding arbitration unless otherwise prohibited by local law.
